EB-1 VISA

Unlike the O-1 visa, the EB-1 visa is a permanent visa. This means that an EB-1 visa holder can apply for permanent residency in the United States. After receiving an EB-1 visa, the immigrant can apply for lawful permanent residency, or a “green card,” through a separate application.

The EB-1 visa requirements are like O-1 visa requirements (listed above) but are more intensely reviewed and scrutinized by the government.  In addition to the O-1 visa required evidence, an applicant must demonstrate their work will benefit the United States and that they intend to continue to work in their area of expertise after issuance of permanent residency. While a job offer is not necessary to apply for the EB-1 immigrant visa, it does help demonstrate the immigrant will continue practicing in their area of expertise after a grant of permanent residency.
