In many circumstances, when the Department of Homeland Security (“DHS”) seeks to have someone removed or deported from the United States they place the individual into removal proceedings before a United States Immigration Court. This is done by serving the individual and the Immigration Court with a document known as the Notice to Appear (“NTA”). The NTA lists allegations made by DHS against the individual, and explains why DHS believes that that person is inadmissible to or removable from the United States. These removal proceedings are extremely important to an individual’s immigration case, as the Immigration Court will often make the final decision as to whether or not an individual is allowed to remain in the United States.
